The homeowners’ association board of directors has the power to make certain rules and regulations to a Northeast Fl condo community. What about banning smoking in a condo? The board can eradicate smoking if it is taking place in indoor common spaces. For example, recreation rooms or shared hallways may be banned from smoking. Anything that is outdoors is not so easily banned from smoking. An outdoor ban would violate certain local laws. Florida Condo associations have the power to enforce and development reasonable laws for the common use of the property. A ban on all smoking, however, does not apply to the parameters of their power.
